NovaSwap — Terms of Service
Effective: October 2026. DRAFT — pending review by a qualified cryptocurrency attorney before mainnet launch.
1. What NovaSwap is
NovaSwap is a software interface that helps you route crypto-to-crypto swaps through third-party protocols and liquidity sources. NovaSwap is not the underlying blockchains, smart contracts, or liquidity protocols — those are independent third-party systems we do not control, operate, or guarantee. Using this interface does not create any agency, partnership, fiduciary, or advisory relationship between you and NovaSwap.
2. Non-custodial — we never touch your funds
NovaSwap does not hold, control, escrow, or take custody of your crypto or private keys at any point. Every swap is signed inside your own wallet and settled on public blockchains. If you lose access to your wallet, we cannot recover your funds.
3. Crypto-to-crypto only
NovaSwap supports swaps between cryptocurrencies only. There is no fiat on-ramp or off-ramp. We do not process US dollars or any government currency.
4. Fees — disclosed before you sign
NovaSwap charges a flat 0.3% integrator fee on swaps. The exact fee amount is shown in every quote before you sign the transaction — if you don't like it, don't sign. Network (gas) fees and liquidity-provider fees are separate, set by the underlying blockchains and protocols, and outside our control.
5. Eligibility
You must be at least 18 years old. By using NovaSwap you represent that: (a) you are not located in, and are not a citizen or resident of, any jurisdiction where crypto swaps are prohibited; (b) you are not named on, and are not owned or controlled by anyone named on, any sanctions list, including OFAC's Specially Designated Nationals list; and (c) your use complies with all laws applicable to you.
6. Sanctions screening
Connected wallet addresses may be screened against sanctions and blocklists. Blocked addresses will be refused service, and circumventing these controls is prohibited.
7. Not financial advice
Quotes, prices, token lists, and any other information in the app are for informational purposes only and are not financial, investment, tax, or legal advice. Nothing here is a recommendation or solicitation to buy or sell any asset. Token listings are objective and neutral — inclusion is never an endorsement.
8. Assumption of risk
Crypto assets are volatile — you can lose some or all of your money. Blockchain transactions are irreversible; we cannot reverse, cancel, or refund a swap once signed. Smart contracts can have bugs or be exploited. Prices can move between quote and execution. You accept all of these risks by using NovaSwap.
9. Prohibited uses
You may not use NovaSwap for illegal activity, money laundering, terrorist financing, sanctions evasion, market manipulation, or to trade leveraged, margined, or derivative products where prohibited. We may refuse service to any transaction we reasonably believe violates these terms or the law.
10. Taxes
You are solely responsible for determining and paying any taxes arising from your swaps. NovaSwap does not provide tax advice or reporting.
11. No warranties; liability cap
The app is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, NovaSwap's total liability for any claim arising from your use is capped at the fees you paid us in the 12 months before the claim (or $100 if greater clarity is needed — attorney to confirm). We are not liable for losses from market movements, smart-contract failures, wallet issues, network congestion, or third-party protocols.
12. Indemnification
You agree to indemnify and hold harmless NovaSwap and its operator from claims arising from your use of the app or violation of these terms.
13. Governing law and disputes
These terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules. Disputes will be resolved by binding arbitration on an individual basis — no class actions. (Attorney to confirm venue and arbitration rules.)
14. Changes
We may update these terms; material changes will be noted with a new effective date above. Continued use after changes constitutes acceptance.
